EPA GRANT

Our Dept. of Community Development has been selected as a finalist for federal EPA grant funds to create a new customer service desk that will provide educational information, staff consultation and permit application guidance. The proposed Watershed Stewardship Resource Center (WSRC) will be an optional first step for those proposing new development activities, and an information hub for all interested citizens. One component will be to provide easy-to-understand guidebooks and brochures about the new SMP, current critical area and stormwater regulations, non-regulatory best management practices, and more. CODE INTERPRETATION

Also, the State Legislature recently changed the law to clarify the relationship between shoreline and critical area regulations. In response, Jefferson County has issued a code interpretation to explain how ESB 1653 will affect local permitting. Primarily, permit and approval applications received on or after March 18, 2010 will be affected. Greetings Jefferson County Commissioners and County Administrator,

The attached Code Interpretation is in response to legislative adoption of EHB 1653 on March 18, 2010. It affects the application of the critical areas ordinance within Jefferson County shoreline jurisdiction.

Key points:

The UDC Code Interpretation regarding Relationship between Growth Management Act (GMA) and Shoreline Management Act (SMA) jurisdiction dated August 22, 2008 is hereby rescinded;
CAO provisions adopted after July 27, 2003 shall apply within shoreline jurisdiction despite the absence of an update to the shoreline master program; however
Applications vested prior to March 18, 2010 shall be reviewed per the codes and code interpretations in effect on the date of vesting including the August 22, 2008 code interpretation, as applicable; and
Codes in effect, including critical areas ordinances retroactive to July 27, 2003, shall apply to development within shoreline jurisdiction with a vesting date on or after March 18, 2010, the effective date of EHB 1653.
